Amendments to the Uniform Civil Procedure Rules

On 4 November 2019, the Uniform Rules Committee approved Amendment No 92 to the Uniform Civil Procedure Rules, an amendment to forms 40 and 45, and the creation of form 163.

Amendment No 92:

The amendment creates Division 3 of Part 31.

Division 3 of Part 31 provides rules concerning interpreters based on the Model Rules set out in the Recommended National Standards for Working with Interpreters in Courts and Tribunals prepared by the Judicial Council on Cultural Diversity.

Please note that the amendment commenced and was published on the NSW Legislation Website on 8 November 2019.

Attached here is a copy of amendment number 92.

UCPR Forms 40, 45 and 163:

On 4 November 2019, the Uniform Rules Committee approved an amendment to UCPR form 40 – Affidavit, UCPR form 45 – Registration/filing of certificate of judgment or order, and the creation of UCPR form 163 – Witness Statement.

Form 40, attached here, was amended to include a certification to be given by an interpreter in the form of an affidavit.

Form 45, attached here, was amended to remove an incorrect reference to the Civil Procedure Regulation 2005.

Form 163, attached here, was created to provide a form for a witness statement to be given and to include a certification to be given by an interpreter in the form of an affidavit.

All three forms will be published at http://www.ucprforms.justice.nsw.gov.au/ on Monday 11 November 2019.
