High Court Dinner for New Silks - Monday 31 January 2011

Competition to name the Barristers' Dispute Resolution Service

Martin Hadley of Windeyer Chambers is the winner of a competition to re-name the Barristers’ Dispute Resolution Service, with his entry "BarADR". The Barristers’ Dispute Resolution Service will be re-launched in early 2011. The ADR Committee recently ran a competition to find a catchy name that encapsulates what the service is about, which is to provide a portal for the provision of ADR services by the New South Wales Bar. Martin will receive two complimentary movie tickets.

Professional Standards Scheme - update on mutual recognition and prescription

The Bar Association’s new professional standards scheme which limits liability for damages to $1.5 million commenced on 1 July 2010 and expires on 30 June 2015. The scheme is recognised in the ACT, Western Australia, Victoria and the Northern Territory.� The scheme is expected to be gazetted in Queensland in the near future.� Members will be advised via _In Brief _of any developments regarding mutual recognition in Qld. Safe Work Australia has released the Twelfth Edition of the Comparative Performance Monitoring (CPM) report on Australia’s work health and safety and workers’ compensation outcomes for the 2008-09 year. The Comparative Performance Monitoring (CPM)�reports provide trend analysis on the work health and safety and workers’ compensation schemes operating in Australia and New Zealand. Information in the report is designed to help gauge the success of different approaches undertaken by the various workers’ compensation and work health and safety authorities to reduce the incidence of work-related injury and disease.

The Bar Council has approved the release of the Association's Criminal Justice Reform Submission which contains a number of suggestions for the reform of the criminal law in advance of the March 2011 NSW election. This morning, Stephen Odgers SC, chair of the Criminal Law Committee, was a guest on 2GB's Breakfast Show, with Andrew Moore. A transcript of the interview is held by the Bar Library.

Appointment to the Family Court

Attorney-General Robert McClelland today announced the appointment of Mr Colin Forrest as a judge of the Family Court of Australia. Mr Forrest was admitted to the Queensland Bar in 1990 and has practised predominately in family, child support and de facto relationships law, equity, wills and estate litigation. Mr Forrest will take up his appointment in February 2011.

Law Council statement on Julian Assange

The president of the Law Council, Glenn Ferguson, has issued a press statement urging the Australian Government to continue its consular assistance to Julian Assange and cautioned that any possible charges relating to leaked cables should be dealt with by due process.

"The Law Council considers that any person accused of a crime is entitled to the presumption of innocence and a fair trial in relation to the matters for which he or she is brought before a court, irrespective of whether that is within Australia or overseas", said Mr Ferguson.

New South Wales Bar Association Criminal Justice Reform Submission

The Bar Council has approved the release of the Association's Criminal Justice Reform Submission which contains a number of suggestions for the reform of the criminal law in advance of the March 2011 State election.

The� Submission was prepared by the Association's Criminal Law Committee following the Criminal Justice Reform Conference held in September 2010. � The Policy proposes a new scheme for fitness to be tried in summary matters for mentally ill persons and endorses Sentence Indication Hearings. A substantial portion of the Policy addresses critical issues in relation to the sentencing of Aboriginal offenders and proposes the reform of various elements of the criminal law to ensure that Aboriginal offenders are dealt with in a fair and equitable manner.

The President has written to the Attorney General and Shadow Attorney General enclosing a copy of the Submission for their consideration.

Commencement of the Criminal Case Conferencing Regulation

The Criminal Case Conferencing Trial Further Amendment (Extension) Regulation 2010 commenced today, 10 December 2010. The object of the Regulation is to extend the operation of the Criminal Case Conferencing trial until 1 July 2011. The trial operates under the _Criminal Case Conferencing Trial Act 2008 _and provides for compulsory pre-committal conferences and the codification of sentence discounts for guilty pleas in certain criminal matters conducted in Sydney. The NSW Government is still considering the future of the Criminal Case Conferencing scheme.

Safe Work Australia has called for public comment on draft model Work Health and Safety Regulations and priority model Codes of Practice. The Safe Work Australia web site features an exposure draft of the model Work Health and Safety Regulations, priority model Codes of Practice and an Issues Paper. The public comment period will close on 4 April 2011. Public submissions can be sent to: submissions@safeworkaustralia.gov.au

Web watch: the Legal Information Institute of India

The Legal Information Institute of India is now open for public access at <http://liiofindia.org/>, prior to its formal launch in India in early 2011. LII of India at present has 50 databases, including over 300,000 decisions from 37 courts and tribunals, Indian national legislation from 1836, over 800 bilateral treaties, law reform reports and about 500 law journal articles. The LawCite citator tracks case and journal article citations. Further case law, and state and territory legislation, will be added by the time of the formal launch.

There's the usual mix of book reviews, photos of social events, coverage of recent appointments to state and federal courts and the Tri-State Bar Football Competition. John Michael Fitzgerald has been appointed as a public defender for the period commencing on 25 January 2011 and expiring on 4 June 2017.

Mr Peter John Wertheim AM has been reappointed as a member of the Anti-Discrimination Board for the period commencing on 8 December 2010 and expiring on 29 September 2012.

The Hon Paul Leon Stein AM QC has been reappointed as a member and as chairperson of the board of the Law and Justice Foundation of New South Wales for the period commencing on 6 December 2010 and expiring on 5 December 2013.

Solicitors v Bar and Bench Golf Day - 23 January 2012

The annual Solicitors v Bar and Bench Golf Day is to be held at Elanora Golf & Country Club on Monday, 23 January 2012.� Local rules include no mobile phone usage (except in the car park) and no socks with emblems on them. The cost for the day is $160.00 including dinner. (No discount for Golf only. Elanora members pay $80.00).

The event will be the usual 2 ball event with matches between the Bar and Bench v Solicitors based on their respective 2BBB score.� Registration will be at 12 noon with a view to hitting off at 12.30.�
