Supreme Court re-issues three practice notes

Chief Justice Bathurst�has re-issued three Supreme Court of NSW practice notes, SC CL6, SC Eq 10, and SC Eq 5, which supersede versions issued, 19 March 2012, 22 September 2010, and 23 December 2008 respectively. The changes to all three practice notes�took effect on�10 August 2012.

SC CL 6 - Possession List

A new Usual Order for Hearing has been added to the Note at Annexure 2, which has prompted a re-write of paragraph 27.

A further minor amendment is made to paragraph 52 so that the paragraph no longer solely refers to investigations by the Financial Ombudsman.� Thirdly, a minor correction to paragraph 29 is included so that the Note reflects the reduced hours of operation for the Duty Registrar, who since January this year serves his/her last client at 4.30pm instead of 5pm.

SC Eq 10 - Revenue List

There is an addition of a template summons at Annexure A of SC Eq 10 to help parties commence Chief Commissioner proceedings in the List.

SC Eq 5 - Expert Evidence

There is an amendment to paragraph 15 that includes the Revenue List as a specialist case management list in the Equity Division within which directions for expert evidence can be sought from the presiding judge.
