Crown rates for junior and senior counsel - an update

As reported by in-brief last month, the Attorney General has approved the following increases in Crown rates for junior and senior counsel, effective 18 October 2010: junior counsel - $240 per hour with a daily maximum of $1,800 plus GST; senior counsel - $400 per hour with a daily maximum of $4,000 plus GST. These rates include all overheads, secretarial, legal and administrative assistance but _not _out of pocket disbursements.

Advice has now been received from the Attorney General's Department that these increases apply only in respect of "Attorney General's matters", that is, matters where the Crown Solicitor is acting on behalf of the Attorney General or his Department.

The new rates do not apply in respect of Crown Solicitors matters where the Crown Solicitor is acting for other Government agencies.�

The Association is continuing its negotiations in this regard, and members will be kept informed as to developments.
