Inquiry into judge alone trials

The Legislative Council's Standing Committee on Law and Justice has published the report of the Inquiry into Judge Alone Trials Under s 132 of the Criminal Procedure Act 1986. Under its terms of reference, the committee inquired into whether either party in criminal proceedings whould be allowed to apply to the court for trial by judge alone, without a requirement that the prosecution consents to the application. The proposed model shifts the application and decision making process from the ODPP to the courts. Learn more>
