Bar Association submission critical of NSW anti-protest law

Thu Mar 17 2016
Advocacy

The NSW Government's legislation to limit protections for peaceful protests, increase police powers and raise penalties for certain protest actions, has passed both houses of the NSW Parliament. The Bar Association made a submission in respect of The Inclosed Lands, Crimes and Law Enforcement Legislation Amendment (Interference) Bill 2016. The submission raised concerns regarding many provisions in the bill, such as the creation of a new criminal offence - "aggravated unlawful entry on inclosed lands" - and restrictions on the right to participate in peaceful assembly. The Bar Association's submission featured in debate, which is recorded in the Hansard here and here. The association's concerns were reported in the Guardian, which can be viewed here.
