Commencement of Civil Liability Act reforms for organisational child abuse liability

The governor has proclaimed the proper defendant reforms for organisational child abuse liability contained in Division 4 of Part 1B of the Civil Liability Act 2002. That Division will commence on 1 January 2019.

A new rule will be added to the Uniform Civil Procedure Rules 2005 to facilitate the operation of the proper defendant reforms. That rule will also commence on 1 January 2019.

The Act passed is attached. Following the consultation on the draft bill, the bill was revised slightly—the reforms remain substantively as proposed. Further information, including the second reading speeches and explanatory note are available here.
