Victorian Court of Appeal decision on conditional costs agreements

In Mainieri & Anor v Cirillo [2014] VSCA 227, the Victorian Court of Appeal has confirmed that the indemnity principle is satisfied by a conditional costs agreement where the client who is represented pro bono is liable to pay costs if they receive a costs award in their favour. The judgment brings a degree of certainty to the question of whether a client with pro bono representation can be awarded costs. Learn more here.
