Coming up: AACL seminar on judicial appointment reform

The Australian Association of Constitutional Law will host a seminar on "Revisiting Judicial Appointments Reform in Australia", to be held on Monday, 19 October 2015 in Court 18B of the Federal Court, Queens Square, between 5.30pm and 7.00pm. The paper will be presented by Professor Andrew Lynch (University of NSW). Commentators will include the Hon Justice Julie Ward (NSW Court of Appeal); Mr Philip Selth OAM (executive director, NSW Bar Association); and Professor Gary Edmond (University of NSW). Ten years ago, a number of Australian proposals for the selection of judicial officers were influenced by reforms in the United Kingdom: the Judicial Appointments Commission and the selection processes created under the Constitutional Reform Act 2005 (UK). It is now timely to reconsider the key Australian reform proposals in light of the UK experience.

This paper addresses the objectives of the reform process, and how these objectives might influence design choices. In keeping with the UK discussion, the paper considers that judicial diversity warrants greater attention in the existing Australian proposals, and that it should inform structural decisions about the allocation and constraint of power in the selection process.
