Costs Disputes - Amendment of the Legal Profession Uniform General Rules 2015

On 1 July 2019 the Legal Profession Uniform General Amendment (Indexation) Rule 2019 will commence. It adds rule 111A to the Legal Profession Uniform General Rules 2015.

The Legal Services Council (LSC) made the rule on Indexation to ensure the Victorian and NSW Legal Services Commissioners, and the Victorian Civil and Administrative Tribunal, maintain their jurisdiction to determine costs disputes in line with inflation. Rule 111A will apply to sections 291-293 of the Uniform Law (and s 99 of the Legal Profession Uniform Application Act 2014 (Vic)).The Legal Services Council has also released an Indexed Amounts Notice.

The effect of the new rule and the notice will be that from 1 July 2019 to 30 June 2020 the indexed amounts for the purposes of sections 291-293 of the Uniform Law (and s 99 of the Legal Profession Uniform Application Act 2014 (Vic)) will be as follows: $10,000 indexed to $10,685; $100,000 indexed to $106,835; and $25,000 indexed to $26,710.
