SCNSW issues new Practice Notes for Possession List and Mediation

Chief Justice Spigelman AC has approved changes to the Supreme Court's Practice Notes covering the Possession List and mediation. The amended Practice Notes were issued on 10 March 2010, and both commence today, Monday, 15 March 2010.

The changes to the Mediation Practice Note comprise of very minor changes to the Definitions section and paragraph 10. The changes to the Possession List Practice Note are more extensive. A new paragraph, paragraph 52, has been added to the Note. Paragraph 52 deals with the notification requirements under s 71A of the Residential Tenancies Act 1987� and the evidence the court requires from the plaintiff. There have also been changes to the paragraphs governing directions hearings, stay applications and alternative dispute resolution.
