Papers to note: amendment to the UCPR

On 4 October 2016, the Uniform Rules Committee approved Amendment No 78 to the Uniform Civil Procedure Rules.

The amendments are to rules 4.10, 4.12 and 10.8. Each of these rules relates to the filing and service of documents with court registries by using an authorised document exchange (DX) system.

Some registries have ceased using DX as a means to send and receive documents for filing. Notably, the Supreme Court ceased using DX on 30 September 2016. The amendment to each of these rules omits outdated references to the use of DX addresses for registries. For those registries still using DX, a broad interpretation of ‘post’ will be given to accept documents for filing by DX.

The amendment was published on the NSW Legislation Website on 14 October 2016 and commenced today.
