The High Court on advocate's immunity

The High Court, by majority, has allowed an appeal against a decision of the NSW Court of Appeal. In Attwells & Anor v Jackson Lalic Lawyers Pty Limited [2016] HCA 16, the court held that the advocate's immunity from suit does not extend to negligent advice given by a lawyer which leads to the settlement of a case by agreement between the parties embodied in consent orders.
