The High Court today handed down its decision in the matter of McKell v The Queen, unanimously allowing an appeal from a decision of the NSW CCA, quashing the appellant's conviction for drug-related offences, and ordered a new trial.

The court unanimously held that "the trial judges comments were so lacking in balance as to be an exercise in persuading the jury of the appellant's guilt, were unfair to the appellant, and gave rise to a miscarriage of justice".
