N.S.W.R now online

The complete N.S.W.R. report series (from 1960-1970) is now available to read online for free on the NSWLR website www.nswlr.com.au under the Early Reports tab, or you can download a PDF copy of an individual case using the pay-per-view facility.

You can now search for any case reported in the NSWLR, State Reports (NSW) or N.S.W.R. series and obtain a copy for just $18.00 plus GST. Go to www.nswlr.com.au and type in the case name or citation in the search box.

Katrina Dawson Award - applications now open

Katrina Dawson was a much-loved member of the New South Wales Bar, where she excelled. She was tragically killed during the Lindt Cafe siege. The Katrina Dawson Award seeks to encourage women to practise at the bar. The award is open to women who have passed the New South Wales Bar exam and committed to enrolling in a Bar Practice Course within 18 months of winning the award. Applications are now open and will close on 15 April 2019. Applications must be submitted online. Learn more here.

The Hayne Royal Commission: Implications for lawyers?

The Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry handed down its final report on 1 February 2019. Although the report did not focus on the conduct of lawyers, what it said about the conduct of participants in the financial services industry has implication for the legal profession.

The Australian Academy of Law will hold its first event for 2019 in Sydney on Monday, 25 March at 5.00pm - 6.30pm in the Banco Court, Queens Square. Among the distinguished panellists will be Phil Boulten SC, former president of the Bar Association. Reserve your place here.

New Barristers’ Committee Cross-examination Seminar and Workshop

There’s still time to register - Part 2 - 28 March 2019

The New Barristers’ Committee Cross-examination Seminar and Workshop is aimed at encouraging junior barristers to practice their cross-examination skills on each other before attending the demonstration to watch senior members of the profession cross-examine and discuss their approach to the same problem. The two-part workshop is relevant to both civil and criminal practitioners.

The first session of the New Barristers’ Committee 2019 Cross Examination Workshop was held on 21 February 2019 and is now available of CPD Online. To view the seminar please click here. The seminar conducted by Michelle Painter SC (9th floor, Selbourne Chambers) and Marcus Pesman SC (Queen's Square Chambers) discussed cross-examination technique.

Part two of the Cross Examination Workshop will be held on 28 March 2019 and will include a demonstration of cross-examination technique by Tunc Ozen SC (Public Defender) and Neil Adams SC (Crown Prosecutor). The demonstration will take place in the Banco Court, Level 13, Supreme Court, starting at 5.15pm. The presiding judge will be The Honourable Justice Bellew.

Swearing in Ceremony for Mr Stephen Olischlager to the Local Court of NSW

On Monday 25 March 2019 at 9.00am in courtroom 5.2 of the Downing Centre Local Court there will be a Full Bench ceremony to mark the swearing-in of Mr Stephen Olischlager as a Magistrate of the Local Court of New South Wales. All members are invited to attend.

Julia Roy will speak on behalf of the NSW Bar. Wigs and gowns are not to be worn.

Welcome ceremony for Angus Stewart

Justice Angus Stewart was appointed as a Judge of the Federal Court of Australia, to be resident in Sydney, with effect from 25 February 2019.

A ceremonial sitting of the Full Court of the Federal Court of Australia will be held in Sydney at which the new Judge will be welcomed. The sitting will be held at 9.30 am on Monday, 25 March 2019 in Court 1, Level 21, Federal Court of Australia, Law Courts Building, Queens Square, Sydney.

Members of the NSW Bar Association are invited to attend. Michael McHugh SC will speak on behalf of the NSW Bar Association. Barristers are to wear robes, wigs are not worn.

SMH Half Marathon - Join the NSW Bar team today!

The New South Wales Bar has formed a team for runners in the Sydney Morning Herald Half Marathon on Sunday, 19 May 2019 to raise money for the Black Dog Institute. Bart Vasic, Iain Todd and Arthur Moses SC and John-Paul Redmond are already signed. If you'd like to run with the NSW Bar Half Marathon Team, follow this link. Director of Public Prosecutions Reference No 1 of 2017 [2019] HCA 9

The High Court has held that a trial judge may not direct a jury in a criminal trial that it is open at any time after the close of the prosecution case to acquit the accused if the jury consider the evidence is insufficient to support a conviction. Such a direction, commonly referred to as a “Prasad direction”, is not permissible under the common law of Australia.

Further, the Court held that the common law of Australia does not recognise that the jury empanelled to try a criminal case on indictment have a right to return a verdict of not guilty of their own motion at any time after the close of the prosecution case.
