Wednesday, March 06 2019 - 2019 Bathurst Lecture - Is the modern company fit for purpose?

The 2019 Bathurst Lecture, named in honour of the Hon T F Bathurst AC, Chief Justice of NSW, will be held at 5.15pm on Wednesday 6 March 2019 in the Banco Court. The 2019 Bathurst Lecture will be delivered by Graham Bradley AM. Mr Bradley is a senior company director, former President of the Business Council of Australia and former Deputy President of the Takeovers Panel. He is currently the Non-Executive Chairman of HSBC Bank Australia, Virgin Australia International Holdings, EnergyAustralia Holdings and GrainCorp Limited. Mr Bradley is also the Chairman of Infrastructure NSW and a director of Tennis Australia. Learn more here.

Early Appropriate Guilty Plea reforms

The New South Wales Bar Association's Criminal Law Committee has been invited by the Department of Justice to participate in consultations throughout 2019 on the implementation of the Early Appropriate Guilty Plea (EAGP) reforms. The first consultation meeting will be held on 25 February 2019. To assist the association in its participation in the consultations, the committee will collate information as to the workings of the EAGP reforms and the experiences of practitioners with the scheme. Members who have had experiences with the EAGP reforms please email any feedback/comments to the Bar Association’s Senior Policy Lawyer, Ms Ting Lim at tlim@nswbar.asn.au.

Swearing in of Alister Abadee to the District Court NSW

Alister Abadee has been appointed as a Judge of the District Court of New South Wales.

A formal ceremony to honour this occasion will be held in the John Maddison Tower on Level 21, at 9:00am on Thursday 21 February 2019. All members are invited to attend.

Paresh Khandhar SC will speak on behalf of the NSW Bar. Barristers should wear wigs and gowns. Senior counsel should wear full-bottomed wigs.

Brahma Kumaris Centres for Spiritual Learning are offering A Well Being Retreat for Lawyers and their Associates starting from 10 am on Saturday 23 March 19 and finishing with lunch at 1 pm on Sunday 24 March at our retreat place at 186 Mt Hay Road, Leura, Blue Mountains. The details are in the flyer attached.

The Brahma Kumaris Centres for Spiritual Learning is a registered charity under the Australian Charities and Not for profits Commission and is run by volunteers. Retreats and activities are offered at no set cost. Contributions by the participants towards running costs is greatly appreciated. We have attached our registration details as well.

We run our organisation and the retreat place with volunteer staff and operate with the voluntary contributions and donations offered by the participants. Our suggested ‘costs’ are $200 per night and food and accommodation as a Charity that depends on the voluntary donations and contributions.

The contributions are asked to be put in a donation box for cash payments or we take electronic payments as well. We have been operating this way our Leura retreat place for about 15 years and all our centres for about 40 years.

Class Actions half-day and Preparing Expert Witnesses lunchtime seminar

The CLA’s Class Actions Half-day kicks off an interesting morning with Elizabeth Collins SC on lessons from the Banking Royal Commission, followed by a discussion of the latest ALRC recommendations with Matt Corrigan, ALRC; Jason Betts, HSF; Matthew Kennedy, IMF Bentham; Andrew Dawson, Marsh; and Odette McDonald, Phi Finney McDonald. The seminar will conclude with a look at emerging issues in funding class actions with Ben Phi from Phi Finney McDonald. The Chair is Hon Justice Brigitte Markovic.

RACS Fast-Track Judicial Review Workshop

The Refugee Advice and Casework Service (RACS) will run another fast-track judicial review Workshop in Sydney based on the Law Institute of Victoria training materials. It is scheduled for Wednesday, 27 March 2019 from 6.00-8.00pm at Lander & Rogers in the CBD. Participants will need to prepare by viewing training videos and reading materials. It is a great opportunity for those wanting to contribute to RACS’ judicial review referral service Justice for Refugees (J4R) and discuss a hypothetical case with experienced barristers.

2019 Cross-examination Seminar and Workshop

New Barristers’ Committee Cross-examination Seminar and Workshop

The New Barristers’ Committee is conducting a Cross-examination Seminar and Workshop in February and March 2019. This year’s (free) cross-examination workshop is aimed at encouraging junior barristers to practice their cross-examination skills on each other before attending the demonstration to watch senior members of the profession cross-examine and discuss their approach to the same problem. The two-part workshop is relevant to both civil and criminal practitioners.

The seminar will be held on 21 February 2019. The seminar will discuss cross-examination technique. The speakers will provide guidance on cross-examination in an open and relaxed forum, with questions from the floor. The speakers will be Michelle Painter SC (9th floor, Selbourne Chambers) and Marcus Pesman SC (Queen's Square Chambers).

The workshop will be held on 28 March 2019 and will include a demonstration of cross-examination technique by two senior counsel. The demonstration will take place in the Banco Court, Level 13, Supreme Court, starting at 5.15pm. The presiding judge will be The Honourable Justice Bellew.
