Reduction in interest on unpaid legal costs

At its meeting on 2 August 2016, the Reserve Bank Board decided to lower the cash rate by 0.25% to 1.50%, effective 3 August 2016. Section 195 of the Legal Profession Uniform Law (NSW) and section 75 of Legal Profession Uniform General Rules 2015 provide for interest on unpaid legal costs, where the rate of interest is the rate that is equal to the Cash Rate Target as at the relevant date, increased by 2 percentage points.

Accordingly, the maximum rate of interest chargeable on legal costs billed on or after that date is 3.50%. Note that this does not affect the maximum rate chargeable on costs billed before that date.

Criminal Defence Lawyers Association Annual Dinner

The 2016 NSW Criminal Defence Lawyers Association Annual Dinner will be held on Friday, 19 August 2016 at Dockside, The Balcony Level, Cockle Bay Wharf. Arrive at 6.00pm for drinks for a 6.30pm dinner. Guest speaker for the night will be the Honourable Justice Lucy McCallum.

Last month InBrief alerted members to an email, purportedly sent by the Federal Court or the Federal Circuit Court, subpoenaing them to attend court at a specified time. The email also requires the recipient to click on a link to both the court address and case related information. The email, circulating once again, is fraudulent. Do not click on any of the links as they may contain viruses or malware. Delete the item from your in-box and your Deleted folder.

Understanding transgenerational trauma in Aboriginal communities

This is a reminder regarding the seminar on "Understanding transgenerational trauma in Aboriginal communities" which is a joint initiative of the NSW Judicial Commission Ngara Yura Committee, The NSW Bar Association Indigenous Barristers’ Strategy Working Party and the Law Society of NSW Indigenous Issues Committee.

Unfortunately, Professor Mick Dodson AM is unable to attend the event.

Mr Brian Dowd a Gamilaroi man, known in the Aboriginal Community as “The People Mechanic” has agreed to be a panellist for this important event. He is an resilience and self-care specialist in trauma and recovery and will give valuable insight into how to look after your clients, and yourself when issues of transgenerational trauma are present. Mr Brian Dowd will be joined by:

Dr Robyn Shields AM, a Deputy Commissioner at the Mental Health Commission of NSW. As a proud Aboriginal woman Dr Shields has worked in the mental health sector for many years.

Magistrate Sue Duncombe is currently working on the establishment of the first Youth Koori Court of NSW (on a pilot basis).

ABA issues statement on royal commission

The Australian Bar Association has welcomed yesterday’s appointment of Aboriginal and Torres Strait Islander Social Justice Commissioner Mick Gooda and the Hon Margaret White AO as joint commissioners for the Royal Commission into the Child Protection and Youth Detention Systems of the Northern Territory. ABA commentary on royal commission into NT youth detention

The President of the Australian Bar Association Patrick O'Sullivan QC has supported the terms of reference for the Royal Commission into NT child protection and youth detention. According to Mr O’Sullivan , the terms of reference are suitably broad to ensure a thorough inquiry can be undertaken into the treatment of young people in detention within the NT.Mr O'Sullivan has appeared on the ABC to discuss the issue, the transcripts of which can be viewed here and here.

Changes to the Royal Commission into the NT Child Protection and Youth Detention Systems

The Law Council of Australia has congratulated Aboriginal and Torres Strait Islander Social Justice Commissioner Mick Gooda and the Hon Margaret White AO on their appointment to the vital roles of joint royal commissioners to inquire into the Northern Territory’s child protection and youth detention systems. Sports Law Conference and “State of Origin” Football

On 10 September 2016, NSW Bar FC will be defending its rights to retain the Suncorp Perpetual Trophies in the 9th Annual Bar Football "State of Origin" competition against teams drawn from the Victoria and Queensland Bars and to be held in Brisbane.

The games will be preceded by a sports law conference. Attendance at the conference is open to all members of the Bar and Judiciary. A program of events is available here and a separate registration form is available here.
