NSW Bar FC taking on Victoria and Queensland

On 10 October 2015, the NSW Bar FC competes in the 8th Annual Suncorp Football "State of Origin" Tournament against the Victorian Bar and the Queensland Bar at Green Gully Reserve, St Albans, Victoria (the home of the Green Gully Soccer Club). The action kicks off at 1.00pm with Vic v Qld, followed by NSW v Qld at 2.15pm and NSW v Vic at 3.30pm. NSW will be keen to avenge its first ever series defeat in 2014 and bring home the silverware.

The tournament will be preceded by a Sports Law Conference to be held at the Neil McPhee Room (Level 1 Owen Dixon Chambers East, 205 William Street, Melbourne) from 8.30 am to 11.30 am. Speaking at the conference are:

  • Scott Munn, CEO Melbourne City & Chris Nikou, Partner K&L Gates, FFA Director on "The City Group and A-League Participation"

  • Anthony Nolan QC (Vic Bar) on “Legal Issues associated with 'The Blackest Day in Australian Sport'"

  • Rodrigo Vargas, ex-Melbourne Victory & Socceroo and The Big Issue on "Dealing with my Big Issues!" (Grand Finals, Socceroo selection, Transition from A-League & work with young offenders in prison)

Registration for 3 CPD points is a mere $80 with all proceeds being donated to The Big Issue. A light lunch will be served at the conclusion of the conference. All members of the NSW Bar and Judiciary are invited and encouraged to attend the Sports Law Conference and to support your FC in its quest for glory.

ABA announce High Court silk bows and dinner 2016

All new silks for 2015 will be invited to take their bows before the High Court of Australia at 3.30pm on Monday, 1 February 2016 in Courtroom 1. The dinner to mark the occasion will be held that evening in the Great Hall of the High Court at 7.00pm for 7.30pm. All barristers, not just the new silks, and their partners are invited to attend. Members are reminded that nominations for the 2016 Bar Council must be received by the returning officer by 4.00pm on Monday, 12 October 2015. Nomination forms have been posted to all members. The form is also available from the Bar Association’s Reception (ph: (02) 9232 4055, fax: (02) 9221 1149 or email reception@nswbar.asn.au).

All nominations are acknowledged by e-mail to the candidate within 24 hours of their receipt by the returning officer. A candidate who has not received an acknowledgment within 24 hours of when they believe the nomination would have been received by the returning officer should immediately contact the Bar Association on ph: (02) 9232 4055.

Determination of economic and non-economic losses

Pursuant to s 146 of the Motor Accidents Compensation Act 1999 the minister for finance, services and property has made the Motor Accidents Compensation (Determination of Loss) Amendment Order 2015 (NSW), which from 1 October 2015 increases the maximum amounts that are to apply for (a) past or future economic loss - $4,688 and (b) non-economic loss - $511,000.

Pursuant to s 80 of the Motor Accidents Act 1988 the maximum amount that is to apply for past or future non-economic loss under that Act will, from 1 October 2015, be increased by the Motor Accidents Compensation (Determination of Non-Economic Loss) Amendment Order 2015(NSW).

2015 Paul Byrne SC Memorial Lecture

The 2015 Paul Byrne SC Memorial Lecture will be delivered by the Hon Justice Virginia Bell AC on Thursday, 22 October at the University of Sydney. The title of this year's lecture will be "Keeping the Criminal Law in 'Serviceable Condition'- A Task for the Court or the Parliament?". It will take place in the Law Foyer, New Law Building F10, Eastern Avenue of the university's Camperdown Campus. Attendance is free, however registration is essential. Time for Justice Premier's Breakfast 2015 - still some places left

On Thursday, 8 October 2015 International Justice Mission Australia will host a breakfast event with NSW Premier Mike Baird. Explore ways to help strengthen justice systems in our region so that the poor are protected from violence, slavery and exploitation by the commercial sex trade. ABA says PNG Government must lift travel ban on Australian lawyers

The Australian Bar Association is concerned by reports that two Australian lawyers, both of whom have a right of practise in Papua New Guinea, are being denied entry to the country. The Papua New Guinea Law Society, in a statement issued yesterday, confirmed that Greg Egan and Terence Lambert hold current practising certificates. Both lawyers are representing members of the PNG Police in matters relating to a warrant of arrest for the prime minister of PNG, Peter O’Neill. View the ABA media release here.

Supporting charities

The National Breast Cancer Foundation (NBCF) is the leading community-funded national organisation in Australia raising money for research into prevention and cure of breast cancer. Research programs funded by the NBCF cover every aspect of breast cancer, from increasing understanding of genetics to providing better treatments and improving ways to support women and their families. The NBCF relies almost entirely on corporate and community support to continue its work.

The Prostate Cancer Foundation of Australia (PCFA) is the peak national body for prostate cancer in Australia. The PCFA focuses on funding innovative research, support, information and advocacy for men with prostate cancer and raising awareness across the community. PCFA operates over 100 supports groups Australia wide who provide support and advocacy, via the phone or face to face to men and their families affected by prostate cancer. These groups meet regularly and provide a meeting forum for the exchange of experiences, ideas and news as well as an invaluable support network.

New changes to NSW workers compensation and CTP claims! Make Sure you are prepared.

Australian Lawyers Alliance will host two seminars on the changes to workers compensation claims brought about by the Workers Compensation Amendment Bill 2015 and recently decided cases including Cram Fluid Power Pty Ltd v Green. Learn about the CTP Changes, including costs disclosure and recent cases such as Scott v NRMA. The seminar will be held at two locations: Parramatta on 13 October and Sydney CBD on 20 October.

The 2015 Clerks' Conference and Dinner will take place on Friday, 23 October. It will be held in the Manhattan Room at Doltone House. The Guest of Honour at the dinner will be The Commonwealth Solicitor-General, Justin Gleeson SC. The theme of this year’s conference is “Bouncing Back – Building Resilience for a Stronger Future”.

Workers compensation indexation

The Workers Compensation (Weekly Payments Indexation) Amendment Order (No 2) 2015 (NSW) and the Workers Compensation Amendment (Latest Index Number) Regulation (No 2) 2015 are now published on the Legislation NSW website and have taken effect. The object of the first order is to notify the number that equates to the factor B/C - used in the formula for calculating the variation of the weekly payment to be paid to a worker under section 82A of the Workers Compensation Act 1987. That section provides that weekly payments are to be varied on 1 April and 1 October in each year. The second order updates a number used in the indexation of benefits.

Contracts in Commercial Law is an international conference exploring the nature and operation of the law of contracts in commercial law. The speakers for Contracts in Commercial Law are leaders in contracts scholarship and practice drawn from the highest ranks of the judiciary, academy and profession. The conference is convened by Professor Simone Degeling (UNSW Law), The Hon Justice James Edelman (Federal Court of Australia) and Associate Professor James Goudkamp (University of Oxford) and is the successor to the highly successful Fusion Conference (2004), Restitution in Commercial Law Conference (2007) and Torts in Commercial Law (2010).
