Committee on the ICAC examines prosecutions

The New South Wales Parliament's Committee on the ICAC, chaired by Greg Smith SC MP, has released a discussion paper, Prosecutions Arising from Independent Commission Against Corruption Investigations. Among the discussion points, the committee asked if common law offences such as misconduct in a public office, bribery and conspiracy to defraud a public official should be abrogated and replaced by a criminal offence under the Crimes Act 1900. The committee also examines the effectiveness of relevant processes and procedures of the ICAC and the Office of the Director of Public Prosecutions. View the discussion paper here.

Dates for your Diary : NSW Bar Association CPD Conferences 2015

The NSW Bar Association 2015 CPD Conferences have been confirmed for the following dates and locations:

  • Saturday, 21 February: Newcastle
  • Saturday, 28 February and Sunday, 1 March: Orange
  • Saturday, 7 March: North Coast
  • Saturday, 14 March: Parramatta
  • Saturday, 28 March: Sydney

Speaker details and registration forms will be made available over the coming weeks. These will be advertised in In Brief as well as on the NSW Bar Association Website.

Each conference will cover all four mandatory CPD strands (Practice Management, Ethics, Advocacy and Substantive Law) and will comprise a total of six CPD points. For the Orange conference, 10 points will be offered over two days.

After hours entry to the Legal Assistance Cocktails

The cocktail party honouring those involved in the Legal Assistance Scheme, the Duty Barrister Scheme and the Law Kitchen will be held tomorrow evening, beginning at 5.30pm in the Common Room. The entrance to Selborne Chambers is locked and lift access to the Bar Association ceases at 6.00pm. However, arrangements have been made so that attendees may still gain entry up to 6.30pm with a request to the security guard, who will be stationed near the entrance.

Assessment Services reduced operations over Christmas-New Year

New South Wales Government agencies will close down over the Christmas-New Year period, from Monday, 22 December 2014 to Friday, 2 January 2015. The Assessment Services Division, which includes (among others) the Medical Assessment Service and CARS, will have a skeleton staff at their registry counter (located at Level 19, 1 Oxford St, Darlinghurst), for reduced hours, during the close down period. Criminal justice system reflects persistent Indigenous disadvantage

The Productivity Commission has released its 2014 Overcoming Indigenous Disadvantage (OID) report. Although the results indicate some improvements in health and education, adult imprisonment rates are worsening and there are persistently high rates of juvenile detention and family and community violence. Bar Library hours over the Christmas-New Year period

The Bar Library will close at 6.00pm on Friday, 19 December 2014 and reopen at 9.00am on Monday, 19 January 2015. The library will be open from 9.00am to 5.00pm from 19-23 January 2015 and resume normal opening hours on Tuesday, 27 January 2015.

Position vacant: public defender

Attorney General Brad Hazzard is seeking applications from qualified persons for appointment as a public defender under the Public Defenders Act 1995 for a fixed term of up to seven years that may be renewed, and subject to an initial twelve-month probationary period. Learn more here.

New contracts for WorkCover scheme agents

WorkCover has announced which scheme agents will be contracted to provide claims and policy services on behalf of the Nominal Insurer in the NSW workers compensation scheme. The new contract begins on 1 January 2015. Learn more here.

Bar FC Awards Breakfast with HG Nelson

After lengthy and protracted negotiation Bar FC are pleased to have secured a deal with the legend of Australian Sport, HG Nelson to attend their inaugural awards ceremony, to be held on Wednesday, 26 November 2014 at Hyde Park Barracks commencing at 8.00 am. Join them for a review of the past year in football with one of the masters of comedy who remains at the top of his game even after all these years.

Breakfast will be served shortly after 8.00am and will be done by 9.00am to allow those busy trial lawyers time to hit the barrier running at 10.00am. The cost per head is $55. This can be paid in cash or by cheque payable to David Stanton (Maurice Byers Chambers DX 1070 SYDNEY) by 21 November 2014.

Message from President Jane Needham SC

I congratulate all Executive office holders and Bar Councillors on having gained the confidence of our peers to govern this fine association. I am very much looking forward to leading the association with the assistance of the Executive and the Bar Council over the coming year.

It has been an interesting week. One issue – that of whether the bar should approach the government to seek the requisite legislative amendments to enable senior counsel to practice under Letters Patent as queen’s counsel – has caused some controversy in the wake of last week’s Bar Council election result. That result indicates that there is interest among members in the Bar Council pursuing this issue with the New South Wales Government.

The bar faces many challenges, the resolution of the queen's counsel/senior counsel issue among them. But matters such as the continuing response of the bar to the Law Council NARS report, the implications of a national profession, the uniform practice rules, and of course our statutory regulatory functions, will also take up time and require significant and concentrated effort.

I am grateful that my leadership over the past six months has enabled this council to place in me the confidence and trust given to me by the previous council, in circumstances of sustained debate. I will not let you down.

I would like to take this opportunity to thank the executive director and staff of the Bar Association for their devoted and unstinting service.
