Public Defenders Criminal Law Conference, February 2014

The Public Defenders Annual Criminal Law Conference for 2014 will be held on the weekend of 22 and 23 February 2014, at Taronga Centre Harbourview Ballroom and Terrace at Taronga Zoo. Speakers will include the Hon Greg Smith SC MP, Lloyd Babb SC BA MA LLB, Prof Gordian Fulde, and David Dalton SC, among others. The conference is open to all criminal law practitioners and provides ten CPD points across four strands: ethics, personal and practice management, substantive law and advocacy.

Topics will include: Sentencing, Impact of drugs on brain function and the formation of intent, Stress at the Bar: Psychological Strategies for Building Resilience, The importance of the pre-trial application and the vagaries in the subsequent appeal process, Emergency medicine practice : head & other injuries seen in the Emergency Department, Recent High Court cases, The Ethics of Prosecuting, Advocacy : Sentencing, Psychiatric Defences in the Criminal Law and Sexual Assault Communications Privilege (Div 2, Part 5 Criminal Procedure Act).

Sports, Drugs and the Rule of Law

Sport and drugs will be the theme of this year's Rule of Law Conference, to be held between 1.00-6.00pm on 15 November 2013 at the Mint on Macquarie Street. Determination of economic and non-economic losses

Pursuant to s 146 of the Motor Accidents Compensation Act 1999, the maximum amounts that are to apply for (a) past or future economic loss and (b) non-economic loss under that Act have been increased from 1 October 2013 by the Motor Accidents Compensation (Determination of Loss) Amendment Order 2013 (NSW).

Pursuant to s 80 of the Motor Accidents Act 1988 the maximum amount that is to apply for past or future non-economic loss under that Act has also been increased by the Motor Accidents Compensation (Determination of Non-Economic Loss) Amendment Order 2013 (NSW).

Pursuant to s 17 of the Civil Liability Act 2002, the maximum amount that may be awarded for damages for non-economic loss under that Act have been increased from 1 October 2013 by the Civil Liability (Non-economic Loss) Amendment Order 2013 (NSW).

Members are reminded that nominations for the 2014 Bar Council must be received by the returning officer by 4.00pm on Monday, 14 October 2013. Nomination forms have been posted to all members. The form is also available from the Bar Association’s Reception (ph. 9232 4055; fax 9221 1149 or e-mail reception@nswbar.asn.au).

All nominations are acknowledged by e-mail to the candidate within 24 hours of their receipt by the returning officer. A candidate who has not received an acknowledgment within 24 hours of when they believe the nomination would have been received by the returning officer should immediately contact Mrs Corinne Gilbert at the Bar Association on ph: 9229 1754, or e-mail cgilbert@nswbar.asn.au.

Call for papers: 2014 CPD Conferences and CPD Intensives

The NSW Bar Association's professional development department invite members to sumbit suggestions and/or abstracts for papers to be included in the Association's 2014 CPD Conference series as well as the general CPD program for 2014. Seminars forming part of the general CPD program will be held in the Bar Association Common at 5.15pm on weekdays starting from late February 2014. Conferences have been scheduled for Saturdays in February and March 2014 and will be conducted around the state (North Coast, Orange, Newcastle, Parramatta and Sydney).

Suggestions for papers and brief synopses can be submitted to cpd@nswbar.asn.au. Alternatively, you are welcome to contact Anna Hurtig Adair, professional development manager, on 9229 1722.

Tonight's seminar will be presented by Robert Angyal SC with demonstrations by Peter Callaghan SC and Deborah Robinson. The seminar will discuss the various roles counsel might play in a mediation and their respective benefits and/or shortfalls. For full details, please click here.

The paper for the seminar is attached here (copies will also be available at the seminar). The role plays referred to in Part D of the paper are the most important part of the presentation this evening. The role plays can only be seen during the seminar and attendance is greatly encouraged to get the full benefit of the paper.

The role plays are based on the dispute described in Part C of the paper. If you read Part C of the paper before the seminar, you will get more out of the session.

This seminar has been organised by the NSW Bar Association's ADR Committee.

On Sunday, 29 September 2013, a number of members of the NSW Bar took part in the 2013 Distinguished Gentleman’s Ride to help raise funds for research into men’s prostate cancer. Members who took part included the dapper looking Michael McHugh SC of 16 Wardell Chambers, Dean Jordan SC of Forbes Chambers, Dominic Toomey of 11 Garfield Barwick Chambers and Jeremy Gruzman of 8 Garfield Barwick Chambers. Garry McGrath SC of 8 Wentworth Chambers (pictured here on his mean machine in Phillip Street) has promised In Brief that he will participate in next year’s ride to help do his part “to kick prostate cancer in the bum”. As presently advised, there is insufficient evidence to declare the above group of barristers as an Outlaw Motorcycle Gang.

The Benjamin Andrew Footpath Library needs volunteers from the NSW Bar to spend a couple of hours packing books for various hostels in New South Wales at the library’s storage unit at Kennard's Storage in Waterloo. Announcement of appointment of senior counsel for 2013 - 1pm today

The appointment of Senior Counsel for 2013 will be announced at 1pm today.

A copy of the President’s announcement will be emailed to all members and clerks and posted both on the Bar Association’s notice board and webpage (www.nswbar.asn.au).

Individual letters to each applicant from the President may be collected from the Bar Association between 12.30pm-1.00pm. Clerks are asked to arrange for the envelopes for members of their floor to be collected. Applicants whose chambers are outside the CBD and who wish to have the President’s letter emailed to them are asked to advise the Executive Assistant on cgilbert@nswbar.asn.au.

Clerks with successful applicants are asked to ensure the 2013 Silks gather in the Bar Association Common Room on 6 November 2013 for the presentation of Senior Counsel scrolls by the Chief Justice at 5.45pm. Refreshments will be served from 5.15pm. Family and friends are most welcome.

New migration application forms

By way of the recent Administrative Arrangements the department currently known as the Department of Immigration and Citizenship has changed to the Department of Immigration and Border Protection. The Federal Circuit Court’s Migration Application has been updated to incorporate these changes.

AIJA Seminar on restorative justice alternatives

The Australasian Institute of Judicial Administration invites members to a video screening of a seminar on the potential for restorative justice alternatives to the criminal justice system for certain types of sexual assault cases – most notably historic/family cases and so-called "date gone wrong" cases, which frequently result in acquittals. The panel discussion will take place on Thursday, 28 November 2013 at 5.30 pm for 6.00 pm. Learn more here.

Damien Carrick, from Radio National's _Law Report, _will be the moderator.

The AIJA is able to offer members the option to attend this event by video conference from other capital city Commonwealth Law Court Buildings and from New Zealand. Details as to locations and methods for interstate and New Zealand participation will be notified later depending on the degree of member interest.

This "Q&A" will rely on questions to the panel and dialogue with the audience and is designed to allow opportunity to explore the issues in this important area of law. Questions from courts outside Melbourne can be submitted in writing prior to 28 November.

NSW chief justice re-issues three practice notes

Chief Justice T F Bathurst yesterday re-issued Practice Notes: SC GEN 18 - Production of and access to subpoenaed material and returning exhibits and subpoenaed material in civil proceedings; SC CCA 1 - Court of Criminal Appeal - General ; and SC Gen 3 - Copying of court documents. The Practice Notes commence on 7 October 2013 and replace former versions issued, 3 January 2012 , 14 October 2005 , and 16 June 2010, respectively.
