The Honourable Justice J C Campbell will retire as a judge of appeal of the Supreme Court of New South Wales next week. A formal ceremony to mark this occasion will be held tomorrow in Banco Court, on Level 13, at 9:30 am. President Phillip Boulten SC will speak on behalf of the New South Wales Bar. Barristers are to wear wigs (full-bottomed wigs for senior counsel) and gowns.

eServices Information Sessions

The Federal Court is running a series of eServices information sessions, open to practitioners and users of the court’s services. The Online Services Demonstration will be held on Wednesday, 26 September at 4:00 PM. Please RSVP to by COB Friday, 21 September.

The Federal Court has several on-line services to assist with the management of matters. eLodgment, eCourtroom and the Commonwealth Court’s Portal enable practitioners and users to electronically initiate a proceeding, file supporting documents, attend interlocutory hearings via virtual courtrooms and access certain documents. The court’s on-line initiatives provide practitioners, and users of the court’s services, efficient and effective ways of interacting with the court.

Reminder - Farewell ceremonies for Justice Gummow

The Hon Justice Gummow will be farewelled at 10am on Wednesday, 3 October 2012, in Courtroom One at the High Court in Canberra. �This will be a short sitting (around 10 minutes) in which the chief justice will say a few words. �All of the justices will sit. Justice Gummow will sit for the final time on Friday, 5 October 2012, in Sydney at 9:15 am. �This is immediately preceding the special leave list - which is due to commence at 9:30 am. �The location is Level 23, Law Courts Building, Queens Square, Sydney. President Bernard Coles QC will speak on behalf of the New South Wales Bar.

Sydney hosting international law conference in October

The inaugural Joint ANZSIL-Asian Society of International Law Conference will be take place in Sydney on 25 and 26 October 2012.� The theme of the conference, International Law and Justice, will be explored by a wide array of speakers from Australasia, Asia and beyond, in a series of panels over the two days.

The conference will bring together participants from five continents to discuss topical issues relating to the broad theme of international law and justice. Most simply, to what extent can international law be an instrument of justice? Do we all share a common perception of justice and how does justice at an international level relate to other goals such as peace, equality, or development? Has the expansion of international law enhanced international justice and if so, for whom? To what extent has international law embraced the concept of intergenerational justice? The list of thematic panels, to be supplemented by a number of plenary sessions, appears below.

Among the distinguished members of the AsianSIL� who will be speaking on the program or attending the conference are Judge Xue Hanqin, judge of the International Court of Justice, Ambassador Tommy Koh, Ambassador-at-Large, Singapore; Professor V S Mani , President of the Asian Society of International Law ; Professors Onuma Yasuaki, Ramesh Thakur and Ago Shin-ichi, as well as many leading international law scholars and practitioners from Australia and New Zealand.

New workers compensation regulation commences on 17 September

The Workers Compensation Amendment (Miscellaneous) Regulation 2012 (NSW) will commence on Monday, 17 September.�The objects of this Regulation are: (a) to provide transitional arrangements for the operation of the weekly payments amendments made by the Workers Compensation Legislation Amendment Act 2012 in relation to seriously injured workers, and (b) to update an index number that is used for the purpose of the indexation of benefits under the Workers Compensation Act 1987.

Private members bill on Workers Compensation

David Shoebridge MLC has introduced a private members bill into the Legislative Council, the object of which is�to restore the existing scheme for costs in compensation claims, under which the commission may order costs but may not order costs against workers (except in cases of frivolous, vexatious or fraudulent proceedings). Legal Aid NSW Specialist Barrister Panel for Criminal Appellate Matters

The Legal Aid NSW Specialist Barrister Panel (Criminal Appellate Matters) (the panel) will be operational from 17 September 2012. The panel covers the following matters:

•�Provision of advices on the merit of appeals to the Supreme Court including the CCA and the High Court; •�Preparation and conduct of appeals before the CCA and the High Court; •�Preparation and conduct of appeals to the Supreme Court; •�Preparation of applications to review convictions and sentences pursuant to Part 7 and 8 of the Crimes (Appeal and Review) Act.

From 17 September 2012, solicitors in legally aided matters will be required to brief barristers appointed to the panel where a public defender is not available, unless exceptional circumstances exist under the Grants Allocation Guidelines.

Fee rates information is available at For Lawyers. Solicitors will be able to access details of the barristers appointed to the panel on the Legal Aid NSW website under Find A Panel Lawyer.

The number of appointments to this panel is not limited and the panel will shortly re-open for applications. Suitably qualified junior counsel will then be able to submit an on line application at any time. Applications will be considered by the Selection Committee at suitable intervals as published on the Legal Aid NSW website.

Tomorrow is the deadline for submissions on the right to silence

Attorney General Greg�Smith�has announced that�a draft Bill outlining proposed changes to the "right to silence" law has been posted on the website of the Department of Attorney General & Justice today and has encouraged stakeholders to comment on the planned changes. Submissions should be sent to The Director, Criminal Law Review, Department of Attorney General and Justice, GPO Box 6, Sydney 2001, or by email to lpclrd@agd.nsw.gov.au. Submissions may be made publicly available unless you advise that you wish all or part of your submission to be treated as confidential. The closing date for submissions is 28 September 2012.

The amendments will allow magistrates and juries (and judges in judge-alone trials) in proceedings for serious indictable offences to draw an unfavourable inference against an accused who fails to mention facts when questioned by police but later seeks to rely on those facts by way of defence at their trial, subject to the accused having been properly cautioned and afforded an opportunity to obtain legal advice. A fact the accused later relies on is one which, in the circumstances existing at the time of questioning, the accused could reasonably have been expected to mention. Those under 18 years of age and those having a cognitive impairment will be exempt from an unfavourable inference being drawn.
