Ceremonial opening for refurbished Law Courts lobby

The newly renovated lobby of the Law Courts Building, Queens Square was officially opened today. The NSW and federal governments are jointly funding the renovations of the Law Courts building. The project is due for completion in 2013-14. A report on the new lobby will be featured in the next edition of Bar News.

Appointments to the District and Local courts

Attorney General Greg Smith SC has announced the appointment of David Arnott SC as a judge of the District Court of New South Wales commencing on and from 13 February 2012.�

Further, the attorney also announced that solicitors Peter�Feather and Robert�Stone have been appointed as magistrates of the Local Court of New South Wales commencing on and from 26 March 2012. Members will be advised of swearing-in arrangements as soon as they are known.

Michael Barko and Karen Stafford will be sworn in as magistrates of the Local Court of NSW on 13 February 2012. Attorney General Greg Smith SC will speak on behalf of the New South Wales Bar. The ceremony will take place in Courtroom 5.2 of the Downing Centre at 9.00am. No wigs or gowns are to be worn.

When to notify the Bar Council

The legal profession legislation requires a barrister to notify the Bar Council of certain matters:

  • being served with notice of a creditor’s petition
  • presentation of a debtor’s petition
  • compounding with creditors
  • other bankruptcy related events (set out in the definition of ‘show cause event’ in section 4 of the Legal Profession Act 2004)
  • being charged with a serious offence (an indictable offence – defined in section 4 LPA)
  • being convicted of any offence (conviction includes a finding of guilt or the acceptance of a guilty plea – section 11 LPA)
  • change of practice address or other contact details [clause 21 Legal Profession Regulation 2005]

In each case notice is required to be given to the Bar Council in writing within seven days of the event.

The New South Wales Bar Association has issued a media release, announcing that it has joined the Australian Centre for International Commercial Arbitration (ACICA). Angela Bowne SC, who chairs the Bar Association’s ADR Committee, said: "This will position our members to participate in a growing area of legal practice and access solicitors and clients engaged in international arbitration in Australia and overseas".

2012 Public Defenders - Annual Criminal Law Conference

Law Council supports constitutional recognition of Aboriginal and Torres Strait Islander Australians

The Law Council has welcomed the release of the Report by the Expert Panel on Constitutional Recognition of Aboriginal and Torres Strait Islander Australians.

Law Council of Australia President, Ms Catherine Gale, said the landmark report recommends the removal of out-dated, race-based provisions, including one which allows for the exclusion of certain racial groups from voting in state or federal elections and another which contemplates making laws on the basis of ‘race’.

Pan-Orthodox Church Service - opening of Law Term 2012

The 31st Annual Pan-Orthodox Church Service to mark the opening of the 2012 Law Term will be held at the Greek Orthodox Cathedral of the Annunciation, 242 Cleveland Street, Redfern on Tuesday 7 February 2012 at 6:30pm. Practitioners and guests are asked to be seated in the Cathedral by 6:25pm.

The procession to the Cathedral will be led by the Chief Justice of NSW, the Hon Tom Bathurst and will commence from the Rectory of the Archdiocese which is situated in the grounds of the Cathedral.� Those wishing to robe are invited to do so in the Rectory.

Family Law Courts - changes to financial statement kit and form

The Family Court Financial Statement Kit and Financial Statement form have been amended to include the Federal Magistrates Court and therefore are now Family Law Courts Forms.

Financial statement kit (Do it yourself kit). There is a new version of the Financial Statement Kit� which has been amended to include the Federal Magistrates Court (122011 V1).� Changes have been made to page C and Part A and Part M. The Family Court will accept the previous version until Wednesday 29 February 2012.

The NSW Attorney General, Greg Smith SC, yesterday announced the appointment of barrister Michael Barko and senior solicitor Karen Stafford as magistrates of the Local Court of NSW.

Mr Barko and Ms Stafford will be sworn in as magistrates on 13 February 2012.
