Attorney General Greg Smith SC has announced�four new judicial appointments.

The�Honourable Justice Barrett has been appointed as a judge of appeal, effective 25 January 2012.

Geoffrey�Bellew SC has been appointed�as a judge of the Supreme Court of New South Wales, effective�31 January 2012.

James Stevenson SC has been appointed�as a judge of the Supreme Court of New South Wales,�effective 1 February 2012.

Susan Therese O'Neill has been appointed as a full-time commissioner of the Land and Environment Court of New South Wales for the period commencing on 30 January 2012 and expiring on 29 January 2019.

Refurbishment of Queens Square Law Courts Building

The refurbishment of the ground floor lobby in the Queens Square Law Courts Building is progressing on schedule.�Access to Level 4 (Supreme Court Criminal Registry) is now by lift only. Extensive construction work is occurring in the near vicinity and a temporary counter is in place. Completion of the entire refurbished lobby is expected on 23 January 2012, with all public access from Queens Square. A formal official opening ceremony is planned for 31 January 2012. TONIGHT: Comparative Constitutional Law - Final Courts Round-up 2011

This seminar will provide an outline of recent constitutional developments in three jurisdictions – the United Kingdom, New Zealand and Canada – that are of key interest to Australian constitutional lawyers.� Experts from each jurisdiction will report on two or three major constitutional cases argued or decided over the last year; changes in the composition and politics of each country’s highest court; and flag the state of debate over constitutional reform. Together, the panellists will also discuss the potential relevance of these comparative developments for current issues in Australian constitutional law.

The seminar is a public event - Jointly organised by the Gilbert + Tobin Centre of Public Law (UNSW) and the Australian Association of Constitutional Law (AACL).

The Great Bar Boat Race

In�Brief has been�advised that, due to a�variety of factors, the Great Bar Boat Race will not be taking place this year.�However, it has been suggested by those involved in the past that�participants�who might still�be interested should assemble on the day with their boats on Monday, 19 December 2011 at�11:00 am off Shark Island.�Together (or separately)�they can sail�the traditional course (without in any way limiting those who�wish to find a different course)�to Store Beach. It is hoped that�the race will return in 2012.�

Appointments to note: David Re

In September 2011 barrister David Re took up an appointment as a Trial Chamber judge at the�Special Tribunal for Lebanon, based in The Hague. The STL's�primary mandate is to hold trials for the people accused of carrying out the attack of 14 February 2005 which killed 23 people, including the former prime minister of Lebanon, Rafiq Hariri, and injured many others.

Papers to note: new Supreme Court practice note

The Chief Justice T F Bathurst�issued Practice Note SC GEN 18 on 1 December 2011. It takes effect on 3 January 2012.�It details procedure in relation to subpoenas and the production of subpoenaed material. The practice note also deals with the procedure for the return of subpoenaed material and exhibits at the determination of the proceedings, and informs parties of the court's preferred practice in relation to the format of documents being produced, including electronic format.

Bar Association office closure during Christmas holiday season

The Bar Association office will close for the Christmas holiday season at 12.00 noon tomorrow, Friday, 21 December 2012. The association will re-open for business on Wednesday, 2 January 2013. Office hours will be 9.00am to 5.00pm between Wednesday, 2 January and Friday, 25 January. Normal hours of operation (8.00am to 6.00pm) will resume on Tuesday, 29 January 2013.

David Kirby corrects the record on PIC role

Former Supreme Court judge, the Hon David Kirby QC, today clarified his position regarding�the Police Integrity Commission (PIC), in the face of inaccurate media reports.�A spokesperson for Mr Kirby said he had never accepted – nor resigned – from the position as PIC Inspector.�Premier Barry O'Farrell has issued a corresponding media release.

Electronic production of documents under District Court Form 26A

The District Court has recently introduced�Form 26A, a new form of subpoena for the production of documents which provides for their production in electronic form satisfactory to the party issuing the subpoena. Members of the Bar Association required to advise on evidence or generally in relation to the preparat�on of cases should be alert to the risk that privileged documents might fall into the hands of an opposing party which has issued a subpoena and which gets electronic production of the documents. There may not, in some situations at least, be the same scope for getting first access to the documents and making a claim of privilege where appropriate (e.g� in the case of the clinical notes and records of treating doctors in personal injuries cases, forensic accountants and former solicitors in other cases) unless prompt act�on is taken to ensure that that can and does happen.

Amendment to the Director of Public Prosecutions Act 1986

The Director of Public Prosecutions (Disclosures) Bill 2011 yesterday passed through both houses of the NSW Parliament. The object of this bill, as provided by the explanatory notes,�is to amend the Director of Public Prosecutions Act 1986 to ensure that police officers investigating alleged indictable offences are not required to disclose to the DPP information, documents or other things obtained during the investigation that are the subject of a bona fide claim of privilege, public interest immunity or statutory immunity. In such a case, police officers will only have a duty to inform the DPP that they have obtained information, documents or other things of that kind. The Bill temporarily suspends the effect of the decision of the Court of Criminal Appeal in R v Lipton [2011] NSWCCA 247 to enable the continuation of the current practice while a review of the proper scope of the duty of disclosure is carried out. Accordingly, the amendment ceases to have effect on 1 January 2013.

Appointment of Commonwealth senior counsel

Attorney-General Robert McClelland today announced the appointment of Mr James Faulkner PSM as a Commonwealth senior counsel. Mr Faulkner is the head of the Constitutional Policy Unit in the Attorney-General’s Department.

"This appointment is appropriate recognition of Mr Faulkner’s distinguished record of service as a senior legal adviser and his outstanding skills and expertise", said the attorney.
