Refurbishment of Bar Association premises during December-January

The Bar Association's premises will be closed from Monday, 6 December 2010. It will re-open on Monday, 30 January 2011. The association will operate out of temporary offices on Level 1, Selborne Chambers.� The reception will operate from 8.30am to 5.00 pm, beginning 6 December.

Crown rates for junior and senior counsel - an update

As reported by in-brief last month, the Attorney General has approved the following increases in Crown rates for junior and senior counsel, effective 18 October 2010: junior counsel - $240 per hour with a daily maximum of $1,800 plus GST; senior counsel - $400 per hour with a daily maximum of $4,000 plus GST. These rates include all overheads, secretarial, legal and administrative assistance but _not _out of pocket disbursements.

Advice has now been received from the Attorney General's Department that these increases apply only in respect of "Attorney General's matters", that is, matters where the Crown Solicitor is acting on behalf of the Attorney General or his Department.

The new rates do not apply in respect of Crown Solicitors matters where the Crown Solicitor is acting for other Government agencies.�

The Association is continuing its negotiations in this regard, and members will be kept informed as to developments.

Final reminder: applications for 2011 committee membership are due at 5pm TODAY

Members (not just those holding a practising certificate) who wish to join a committee should complete the application form online or in hard copy. Existing members of committees who wish to continue on a particular committee should also complete the form. Expressions of interest will close at 5pm today, Monday 13 December 2010.

The Bar Association is very fortunate that we have many more volunteers for committees than can possibly be accommodated. The president has therefore asked that members restrict their choice of committees to no more than two.

In confirming committee membership, the president ensures that all parts of the bar – geographically, practice areas and seniority – are represented on each committee. Please note that until new committees are established and promulgated, the existing committees continue unchanged. The existing appointments to various working parties and representatives for the Bar Association continue unless and until the President determines otherwise.

Competition to name the Barristers' Dispute Resolution Service

The Barristers’ Dispute Resolution Service will be re-launched in early 2011. The ADR Committee has been busy updating pro-forma agreements; barristers have been approved or accredited as expert determiners, mediators and arbitrators and the stage is almost set. Now all we need is a new name! We’re after a short, catchy name that encapsulates what the service is about, which is to provide a portal for the provision of ADR services by the NSW Bar. The service will have a dedicated section of the website and will use the name to promote barristers practicing ADR to solicitors and the wider community. Papers to note: Family Violence - A National Legal Response

The Australian and NSW Law Reform Commissions were asked in 2009 to examine the interaction of Commonwealth, state and territory laws relating to family violence and child protection. The report, Family Violence - A National Legal Response, makes a number of other recommendations to improve legal frameworks and practices across jurisdictions including:

  • amending the Family Law Act to give Children’s Courts the same power as Magistrates Courts

  • national reforms to sexual assault laws that give victims greater protections in court

  • nationally consistent child protection reforms

  • corresponding jurisdictions giving all courts dealing with violence protection orders the ability to continue dealing with family matters on an interim basis

  • improving the quality and use of evidence, to make it easier for victims to have their stories heard in court

  • the further development of Alternative Dispute Resolution.

Kathleen Trevelyan, who in 1957 became the seventh woman to be admitted to the New South Wales Bar, has died. A funeral will be held at the Northern Suburbs Crematorium at 1.30pm on Friday, 26 November 2010. Donations, in lieu of flowers, should be made to the Salvation Army.

Get your Bar Association photo ID card

The Bar Association will be unable to process applications for identity cards over the 2010-11 Christmas holiday season, due to the planned refurbishment of its premises. Members who wish to apply for a Bar Association ID card should make an appointment with reception on ph: (02)�9232 4055 or to have their photograph taken before the week of 6-10 December. A Bar Association photo ID card can be used when making professional visits to inmates at NSW correctional centres.
