New Version of Federal Court Practice Note IP 1

The Chief Justice of the Federal Court of Australia has issued a new version of Practice Note IP 1 - proceedings Under the Patents Act 1990 (Cth). Read the new version of the Practice Note.

The new Practice Note will commence on 1 July 2010. In the new version, paragraph 1.4 no longer provides that all new proceedings under the Patents Act will be listed before a nominated Patents List Judge for the first directions hearing. The change is intended to reflect new arrangements in the New South Wales registry. whereby new proceedings will now be listed before the Judge on the Patents Panel to whom the proceeding has been allocated.

Statutory appointments announced by the Attorney General

The NSW Attorney General, the Hon John Hatzistergos MLC, has announced the following statutory appointments, which include a number of the Association's members:

Malcolm Turnbull on law, governance and social justice

Members are invited to hear Malcolm Turnbull MP deliver "And Something for the Grandchildren... Intergenerational Fairness" the second annual address in the UNSW series on Law, Governance and Social Justice, which will be held on Thursday, 24 June 2010 at 5.30pm.�

The Law, Governance and Social Justice series is a new initiative by the Law Faculty of the University of New South Wales. It promotes discussion about ways in which laws, legal processes and other aspects of governance can either help or hinder social justice in Australia and overseas. The inaugural address was delivered by Chief Justice James Spigelman of the Supreme Court of NSW. Details are as follows:

New Supreme Court Practice Notes

On 16 June 2010 Chief Justice James Spigelman AC issued four Practice Notes: SC Gen 3 - Copying of Court Documents, replaces the previous version issued on 17 August 2005. SC Gen 13 - Search Orders (also known as "Anton Piller Orders"), replaces the previous version issued on 14 June 2006.

SC Gen 14 - Freezing Orders (aka "Mareva orders" or "asset preservation orders"), replaces the previous version issued on 14 June 2006. SC Gen 16 - Pre-Judgment Interest Rates, was issued on 16 June 2010.

All Practice Notes commence on Thursday, 1 July 2010.

Family Court special sitting to honour Malcolm Broun QC

Malcolm Broun QC is to retire from practice at the New South Wales Bar on 30 June 2010. In recognition of his outstanding contribution to the practice of family law the Family Court will hold a special sitting on 25 June 2010 at 4.30pm in the Full Court, 97-99 Goulburn Street, Sydney.� Senior counsel should wear full-bottomed wigs.

Civil justice reforms in Victoria

Victorian Attorney-General Rob Hulls has heralded the introduction of what he calls "the most significant civil procedure reforms in more than 20 years". In a spirited media release, Mr Hulls foreshadowed a Bill with provisions for "[t]ime limits on talkative barristers, new standards of conduct to stop game-playing, and requirements on parties to try and resolve disputes before going to court".

Victorian Bar Chairman Michael Colbran QC was a little more measured, saying that "[m]any of the provisions of the Bill, for example Alternative Dispute Resolution and case management reflect common practice of the profession and courts for the last 15 years and are unremarkable. NSW has had specific overarching obligations for many years".

Colbran QC also expressed surprise at the attorney's criticisms of barristers. "At no stage of the consultation for the reform was [barristers' behaviour] raised as an issue. He appears to hark back to an outmoded stereotype – which is neither true nor fair - and to be out of touch with modern court practice."

Criminal Justice Reform Conference - early notice and call for papers

The Bar Association will hold its Criminal Justice Reform Conference on Friday, 10 September 2010. Members are invited to submit one-page outlines of proposed reforms in the areas of criminal justice (procedure, substantive law, sentencing). Those invited to speak at the conference will be limited to a 20 minute presentation (with a comparable period for discussion).� Please submit outlines to Stephanie Mancell by Friday, 13 August 2010.

Drug Court for the Hunter Valley

Attorney General John Hatzistergos today announced that the New South Wales Government will introduce the Drug Court program to the Hunter region. Mr Hatzistergos said the Hunter Drug Court would be run from Toronto Courthouse and would service the Newcastle, Lake Macquarie, Cessnock, Maitland and Port Stephens local government areas. Retirement ceremony for Deputy Chief Magistrate Paul Cloran

A ceremonial sitting of the New South Wales Local Court will be held on Friday, 2 July 2010 to mark the retirement of his Honour Deputy Chief Magistrate Paul Cloran. The sitting will take place at 9.00am in Courtroom 5.2 of the Downing Centre. Anne Healey will speak on behalf of the New South Wales Bar.

Micheal Kirby wins prestigious human rights award

The Law Council has congratulated the Hon Michael Kirby who has become the first Australian to win the internationally renowned Gruber Justice Prize. The announcement was made by the Gruber Foundation in New York, with Mr Kirby sharing the prize with Professor John Dugard, of South Africa, and the Indian Law Resource Centre. The Gruber Justice Prize is awarded annually and is worth $US 500,000. The prize recognises Mr Kirby’s contribution to human rights and justice issues over a long and distinguished career. The Human Rights Committee, in cooperation with the Diplomacy Training Council, would like to invite you to an address by Raja Devasish Roy, the traditional Raja, King of the Chakmas of the Chittagong Hill Tracts (CHT) of Bangladesh. Raja Roy is a practising barrister and advocate at the Supreme Court of Bangladesh and former Minster of State in the recent caretaker administration of Bangladesh, until 2009. In 2010 he was elected to the UN Permanent Forum on Indigenous Issues for 2011-13. The seminar will accrue 1.5 CPD points in the Ethics strand. For more details download a flyer.

New Bill focusses on early resolution of civil disputes

The Australian Government has introduced the Civil Dispute Resolution Bill 2010. The object of the Bill, as provided by the explanatory memorandum is "to ensure that, as far as possible, parties take ‘genuine steps’ to resolve a civil dispute before proceedings are commenced in the Federal Court or the Federal Magistrates Court. When commencing proceedings in a court, parties are required to file a statement saying what steps they have taken to resolve their dispute or, if they have not taken any steps, the reasons why". Legal practitioners are also under an obligation to advise their clients of the requirement and assist them to comply.

The Bill draws on recommendations of the National Alternative Dispute Resolution Advisory Council (NADRAC) in its report, The Resolve to Resolve - Embracing ADR to improve access to justice in the federal jurisdiction (November 2009).

NSW Acts 1824-1989 are going online

The New South Wales Parliamentary Counsel's Office is currently capturing Acts as originally assented to from 1824 - 1989 as PDFs and adding them to the NSW Legislation database. Over the coming months these Acts will be progressively added to the web site. To date the years 1824 to 1975 have been added. See Browse As Made or Search As Made.
