Farewell to the Hon Justice Michael Kirby and swearing in ceremony for the Hon Justice Virginia Bell

There will be a farewell for the Hon Justice Michael Kirby at the High Court of Australia in Canberra at 12 mid-day on Monday 2 February.

The swearing in ceremony for the Hon Justice Virginia Bell will take place at the High Court in Canberra at 10.15am on Tuesday 3 February.

At both ceremonies Anna Katzmann SC will speak on behalf of the New South Wales Bar and Tom Bathurst QC will speak on behalf of the Australian Bar Association.

Barristers are to wear robes and wigs. Senior counsel should wear full-bottomed wigs.

Opening of Law Term - Parramatta

An Inter-Church Law Service will be held at Leigh Memorial Uniting Church, 119 Macquarie� Street, Parramatta on Tuesday, 1 February at 9.30am. An Address will be given by The Most Reverend Anthony Fisher, Catholic Bishop of Parramatta. Clergy, judiciary and counsel are invited to robe and take part in the procession. Please arrive prior to 9.15am.

An Ecumenical Service will be held at Christ Church Cathedral, Church Street, Newcastle at 9.30am on Wednesday 4 February 2009 followed by a ceremony and morning tea in the Newcastle Court House at 10.30am. In the evening a Celebration Cocktail Party will be held in the Newcastle Region Art Gallery from 6pm to 9pm. Mr Joe Catanzariti, President, Law Society of New South Wales will be the guest speaker. Cost for Law Society members is $35, non-members $50. Members of the Bar are welcome to attend. Australia Day Honours 2009

In the Australia Day Honours announced on 26 January, the Hon Richard Chisholm was appointed a Member of the Order of Australia (AM) "for service to the judiciary, to the law and legal education, particularly in the field of family law and the welfare and rights of children and young people".

The Hon Acting Justice Ronald Sackville was appointed an Officer of the Order of Australia (AO) "for service to the administration of the Australian judicial system, to the reform of federal and state law, and to legal education".

Yoga at the Bar – New Term commences next Tuesday 3 February

Yoga classes have been running at the Bar Association for the last twelve months.� Participants have reported that they have experienced greater flexibility, improved strength and stress relief.

Bookings are now open for Term 1 classes, which will be conducted on Tuesdays at 7:15am (finishing 8:15am), commencing next Tuesday 3rd February until Tuesday 7th April, 2009 (10 weeks/classes). Classes will be conducted in the Bar Common Room.

Attorney General's Department - new arrangements for client enquiries to Local Court registries

The Attorney General's Department has advised the Association that new arrangements are being put in place concerning client enquiries to Local Court registries.

Under the new arrangements, enquiries will in the first instance be referred to LawAccess NSW for legal information and assistance.�

Local Court registry staff and chamber services will continue to be available to provide specific advice in relation to Local Court procedure and processes.

The new arrangements are set out in a brochure released by the Department entitled "Getting help with legal and court matters".

The Department has advised that the new service delivery model will be introduced over the next few months.

Listings of barristers in the Yellow Pages phone directory

The current listing of barristers in the Yellow Pages directory includes a significant number of former barristers who are now on the bench, have retired or have died.� There are also a number of entries showing incorrect practice addresses. Yellow Pages have advised the Bar Association that they can only amend entries if the individual concerned contacts the directory by phone on 13 23 78 asking that their entry be amended or deleted. Members and their clerks are asked to check their entries in the directory and arrange for necessary changes to be effected.

New Appointment to the New South Wales Local Court

The Attorney General the Hon John Hatzistergos MLC has announced the appointment of Michael Allen of William Owen Chambers as a magistrate of the Local Court of New South Wales, effective 27 January 2009.

A Full Bench ceremony to mark the swearing in will be held in courtroom 5.2 of the Downing Centre at 9am on Tuesday 27 January 2009. Bill Walsh will speak on behalf of the Bar.

Capital works in NSW courts

The Attorney General's Department of NSW meets quarterly with the Bar Association and the Law Society to discuss property and asset related issues. Since the last meeting in November 2008, department has adjusted the timetable of its capital works programme as a result of the NSW mini budget and it is therefore timely to update both organisations on the changes.

Major upgrades of courthouses currently underway at Parramatta, Dubbo and Gosford will not be affected.� The $4.1 million upgrade of Dubbo Courthouse is now complete, while improvements to Parramatta and Gosford courthouses are due for completion in mid 2009.

The current project at the Law Courts Building, Queens Square, is also unaffected including the refurbishment of level 9 which is still due for completion by mid 2009.� A plan for further Supreme Court refurbishments is the subject of an additional funding bid, which will be submitted to NSW Treasury in early 2009.

A master plan for new facilities at the Downing Centre will be accelerated and is expected to be finalised during the current financial year.� The master plan will guide a number of Downing Centre projects over the next four years.

Refurbishment of the cells at Central Local Court and construction of a new courthouse at Armidale will begin in 2010, while the major redevelopment of Wagga Wagga Courthouse is due to start in 2012.

Conference on free access to law in Asia

The Australasian Legal Information Institute (AustLII) will host the first Asia-wide conference on Building Capacity for Free Access to Law in Asia from 24-25 February 2009 at the University of New South Wales. The conference will bring together users of legal information – legal practitioners, academics, judges, law librarians, business & government officials with free-access to law providers.

Speakers will come from across Asia including Japan, Hong Kong, Taiwan, India, Bangladesh, Indonesia, Philippines, Thailand, Vietnam, as well as Australia, New Zealand and the Pacific.� A wide range of topics will be covered as well as three workshops on comparative legal research, sustainable court technologies and building free access resources.

Sydney University Law Library is set to move

The University of Sydney Law Library will close for business at its Phillip Street premises at 6.00 pm on Friday, 23 January 2009.� On Tuesday, 27 January the staff will begin the daunting task of moving books, journals, equipment and people to the new library on the Camperdown campus. It is expected that the library will reopen for business on Monday, 9 February 2009 at 9.00 am. During the closure there will be no access to their collections. Inter-library loans have now ceased and will not resume until 16 February 2009.

The Honourable Acting Justice Handley AO has been reappointed as an acting judge and acting judge of appeal of the Supreme Court of New South Wales for the period commencing on 29 January 2009 and expiring on 28 January 2010.

In addition, Professor Larissa Behrendt, Ms Megan Davis, Dr Mary Edmunds and Ms Rhonda Jacobsen have been reappointed as acting commissioners of the Land and Environment Court of New South Wales for the period commencing on 10 January 2009 and expiring on 9 January 2010.�

Changes to Legal Aid NSW practitioner fees effective from 5 January 2009

Legal Aid NSW has made two changes to practitioner fees aimed at achieving greater consistency across all areas of law. The changes are effective for each new approval from 5 January 2009.

1.�� Reduction in the maximum number of hours hearing time from six hours to five hours per day.� In some areas of law the previous maximum number hours per day was six hours. This was not consistent with other areas of law (e.g. criminal) which have a maximum of five hours.� This change to the maximum number of hours ensures� consistency across all areas of law.

2.��� The 50 per cent solicitor advocate loading for private practitioners in state care and protection matters has been removed. This applies for each new approval. The 50 per cent loading was payable to solicitors appearing in complex matters and/or for additional hearing time after 12 hours of hearing time had been completed. The 50 per cent loading was not offered in other areas of law.

Review of the Dust Diseases claims resolution process

The NSW Department of Premier and Cabinet and the NSW Attorney General’s Department are carrying out a review of the claims resolution process (CRP) for asbestos-related compensation claims in the Dust Diseases Tribunal. Download an issues paper.

That evening, the Australian Bar Association will hold its annual dinner in the Great Hall of the High Court of Australia at 7.00pm for 7.30pm.
